Thane MACT Gives INR 1.35 Crore As Compensation To Kin Of Man Killed In 2018 Bus Accident

The family of a 48-year-old man killed in a bus accident in 2018 has been granted INR 1.35 crore by Thane’s Motor Accident Claims Tribunal (MACT).

In an order issued on February 12 by MACT Chairman S B Agrawal, the owner of the bus involved in the accident and its insurance company have been instructed to jointly pay the compensation amount, as well as an interest rate of 7.5% from the date of petition filing until payment realisation.

The injunction became available on February 26, according to the report.

According to the investigation, on November 11, 2018, a bus on the Sinnar-Shirdi route killed the victim, Agnel Iypunny Chakramakil, a Thane local, and the four other occupants of the car.

Agnel’s 52-year-old wife and 31-year-old son filed a lawsuit demanding INR 2.70 crore in compensation for his death. According to the report ,they said that the bus was driven carelessly on the wrong side of the road, resulting in a crash that killed the patriarch.

According to the report, the bus owner did not attend the tribunal session, but the lawsuit was still brought against him ex parte. Meanwhile, the insurance company denied the family’s claim, stating that Agnel did not have a steady job.

Nonetheless, the tribunal upheld the insurer’s obligation to reimburse the petitioners and confirmed—citing previous decisions—that working in the private sector does not exclude permanent employment status, report

According to the report, the MACT estimated Agnel’s compensation using a multiplier of 13 based on his age, factoring in his monthly salary of INR 1 lakh and an additional 30% for future earning potential. The total compensation of INR 1,35,90,052 includes allowances for loss of income, estate, consortium, and burial costs.

According to the report, the panel ordered that INR 1 crore be deposited in a fixed deposit for Agnel’s wife and INR 5 lakh for his son, with the balance, including accumulated interest, remitted to the lady via account payee cheques.
