Thane Man Booked for Practicing Triple Talaq, a Banned Instant Divorce Method

Authorities in Thane district, Maharashtra, have filed a case against a 31-year-old man for practicing ‘triple talaq’ (instant divorce), which was banned in 2019. The incident came to light on Friday through an official statement.

The man, who lives in the Mumbra area, informed his 25-year-old wife’s father on Tuesday that he was ending their marriage through triple talaq. He reportedly took this step because she had gone for a walk alone.

Following a complaint by his wife, the police registered an FIR against him on Wednesday. He has been charged under Section 351(4) of the Bharatiya Nyaya Sanhita for criminal intimidation and the Muslim Women (Protection of Rights on Marriage) Act.

What is Triple Talaq?

Triple talaq, also known as instant divorce, allowed a Muslim man to divorce his wife by saying “talaq” (meaning divorce) three times in a row. This could be done verbally, in writing, or even electronically. The practice, followed mostly by the Hanafi Sunni sect, is now illegal and a criminal offense in India.

In 2017, the Supreme Court declared triple talaq unconstitutional. The Muslim Women (Protection of Rights on Marriage) Act, 2019 was later passed, making the practice a punishable crime.
